Ahmedabad: A petition has been filed in Gujarat High Court by one Amit Agencies, demanding ban on online sale of medicines by e-pharmacies. The Gujarat High Court issued notices to the central and state authorities concerned, three companies dealing in online pharmacy, five doctors employed in the three companies and the National Medical Council.
The petitioner has alleged that the e-pharmacies are misusing the process by arranging calls between the patients and the medical professionals. Following brief discussions prescriptions are generated and the consulting doctors do not check the medical report of the patient. The petitioner further added certain scheduled drugs are dispensed without any prescription. These can be ordered by anyone which includes minor and could be injurious to health.
Taking cognizance of the petition, Justice A S Supehia sought response from Central Drugs Standard Control Organization, Food and Drugs Control Administration, Tata 1mg Healthcare Solutions Pvt Ltd, Reliance Retail Ltd, Axelia Solutions Pvt Ltd, doctors and the medical council.
“Prima facie, this court is of the opinion that the allegations made in the writ petition appear to be true and if the sale of the scheduled drugs is going on in such a manner, then the same will have direct impact on the health and well-being of citizens” observed the court.
